Report illegal dumping

Please report all illegal dumping to the Council by clicking on the form link above. Please provide as much information as possible. We will investigate and try to confirm/identify where the rubbish came from and if possible, issue a fine to the person(s) responsible.

Issuing fines

Littering and illegal dumping are offences under the Hamilton City Council Waste Management and Minimisation Bylaw 2019. Council can issue infringement fees for these offences under the Litter Act 1979.

Dumped items can be harmful to the environment, dangerous to people and animals, and cost Council (and therefore ratepayers) money to investigate and remove.

If you are issued an infringement fee you must either:

  • pay the fee within 28 days of the notice date, or

  • contact us in writing to offer an explanation or dispute the fee.

 If after 28 days you haven't paid your fee or disputed it, you will be sent a reminder notice, and if the fee is still unpaid, we will lodge it with the Department of Courts. They have the authority to enforce the fee, which will include extra costs.

If you wish to dispute your infringement fee or request a hearing in the District Court, we will advise you of the next steps. If the matter is heard by the District Court, they will determine whether an offence was committed, and they may order you to pay a fine and associated Court costs.

 The following fees apply for littering:

Litter Infringement Notices
Depositing non-dangerous litter from 20 to 120 litres in volume other than on or in a Council park or reserve. $300.00
Depositing non-dangerous litter of up to 120 litres in volume on or in a Council park or reserve. $300.00
Depositing dangerous litter of any quantity in any place. $400.00
?Depositing non-dangerous litter of less than 1 litre by volume other than on or in a Council park or reserve. $100.00
Depositing non-dangerous litter from 1 to 20 litres in volume other than on or in a Council park or reserve. $200.00
Depositing non-dangerous litter of more than 120 litres by volume in any place. $400.00

For serious offences, the Council may file charging documents in the District Court under the Bylaw or Litter Act 1979 for hearing. Those charges carry maximum penalties upon conviction, ranging from fines of $5,000 to $30,000 and a term of imprisonment.
